These Terms of Service for On My Route Limited (doing business as OnMyRoute) ('we', 'us', or 'our') govern your access to and use of our website, applications, and related services (collectively, the 'Services'). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
These Terms apply to all users of the Services, including visitors, account holders, job posters, drivers, and anyone who interacts with the platform.
What is OnMyRoute? OnMyRoute is a peer-to-peer marketplace that connects drivers travelling along a route with individuals or businesses who need goods transported.
Are we a transport provider? No. Unless we expressly state otherwise, we provide the platform only. We are not the driver, carrier, sender, owner of the goods, insurer, or a party to the transport arrangement between users.
Who can use the platform? You must be at least 18 years old to create an account or use the Services.
How are payments handled? Payments made through the platform are processed by third-party payment providers such as Stripe. Additional terms from those providers may apply.
Can users transact outside the platform? Users may choose to communicate or deal outside the platform, but they do so at their own risk. We may take action where off-platform behaviour undermines platform safety, trust, or payment integrity.
Do these Terms remove legal rights? No. Nothing in these Terms is intended to exclude, restrict, or misrepresent any rights that cannot lawfully be excluded under New Zealand law.
By accessing or using the Services, you agree to be bound by these Terms and any policies or guidelines we make available through the platform, including our Privacy Policy, Cookie Policy, and any marketplace, safety, or payment policies we publish from time to time.
If you use the Services on behalf of a business or other organisation, you represent and warrant that you have authority to bind that entity to these Terms.
OnMyRoute is a peer-to-peer marketplace that helps connect people who need items transported with drivers who are already travelling along a route. The Services may include listing tools, route matching, messaging tools, account features, reviews, notifications, payment flows, and related features.
We may add, remove, suspend, or modify features of the Services at any time.

OnMyRoute provides a marketplace and platform services only. Unless we expressly state otherwise, we are not a driver, freight operator, carrier, courier, insurer, customs broker, or warehouse provider. We do not take title to or possession of listed items.
We are not a party to the arrangement between a driver and a job poster. Users are responsible for their own conduct, communications, listings, goods, arrangements, and legal compliance.

Drivers are independent users of the marketplace and are not employees, agents, partners, or contractors of OnMyRoute by reason only of using the Services.

Payments made through the Services are processed by third-party payment providers such as Stripe. By using payment features, you also agree to any relevant third-party payment provider terms, policies, and schedules.
We may charge service fees, platform fees, or similar transaction fees. Any fee charged by us will be displayed before payment is confirmed.
Payout timing may depend on the payment provider’s processes, verification requirements, and payout schedule. We may place holds, delay payouts, reverse transactions where permitted, or restrict access to funds where reasonably necessary for fraud prevention, disputes, chargebacks, platform integrity, or policy enforcement.

The Services may include messaging or communication tools to help users coordinate jobs. You must use these tools lawfully, honestly, and respectfully.
You must not use the Services to harass, threaten, abuse, deceive, spam, or send malicious content to other users.
If users choose to communicate or deal outside the platform, they do so at their own risk. We may take action where off-platform behaviour undermines marketplace trust, safety, legal compliance, or payment integrity.

Examples of prohibited or restricted items may include illegal drugs, stolen goods, hazardous materials, dangerous goods, weapons, live animals where not permitted, and any other goods we determine create unacceptable legal, safety, or platform risk.
If a problem arises, users should first try to resolve it honestly and promptly through the platform where possible.
We may, but are not obliged to, review information provided by the parties and decide what platform action to take. We may request photos, messages, timestamps, descriptions, delivery evidence, or other information relevant to a dispute or claim.
We may suspend payouts, reverse transactions where permitted, remove listings, cancel jobs, issue warnings, restrict accounts, or suspend or terminate accounts where we reasonably suspect fraud, abuse, unlawful conduct, serious policy breaches, or significant safety risks.
Our internal review is intended to support platform safety and integrity. It does not replace any legal rights, dispute resolution pathways, or court processes that may otherwise be available to users.
You may be able to post reviews, ratings, messages, photos, listing details, or other content through the Services ('User Content').
You remain responsible for your User Content and must ensure it is lawful, accurate, and not misleading, defamatory, abusive, or infringing of another person’s rights.
By posting User Content through the Services, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and use that content for the operation, improvement, moderation, promotion, and protection of the Services, subject to our Privacy Policy and applicable law.
We may remove or moderate User Content at our discretion where we believe it breaches these Terms, platform policies, or applicable law.
The Services, including our branding, designs, software, text, graphics, logos, and platform content (excluding User Content), are owned by or licensed to us and are protected by intellectual property laws.
You may not copy, modify, distribute, reverse engineer, sell, or exploit any part of the Services except as permitted by law or by our prior written consent.
To the maximum extent permitted by law, the Services are provided on an 'as is' and 'as available' basis. We do not guarantee uninterrupted access, error-free operation, successful matching, successful completion of any job, or the conduct or performance of any user.
To the extent permitted by law, we are not liable for the actions, omissions, statements, listings, goods, losses, delays, disputes, injuries, damage, or other consequences arising from or relating to:
To the extent permitted by law, our total liability to you for claims arising out of or connected with the Services is limited to the total fees paid by you to OnMyRoute in the three months before the event giving rise to the claim.

We may suspend, restrict, or terminate your access to the Services at any time if we reasonably believe:

These Terms are governed by the laws of New Zealand. Any dispute arising out of or in connection with these Terms or the Services will be subject to the non-exclusive jurisdiction of the courts of New Zealand, unless applicable law requires otherwise.
We may update these Terms from time to time to reflect changes to the Services, our business practices, legal requirements, or platform policies. If we make material changes, we may notify users by email, in-app notification, or by posting an updated version on the platform.
Your continued use of the Services after the updated Terms take effect means you accept the updated Terms.
